Welcome to Fiji Store EU.

This website and online store are operated by Fiji Store Ltd, trading as Fiji Store EU. Throughout these Terms of Service, the terms “Fiji Store EU”, “we”, “us” and “our” refer to Fiji Store Ltd.

Fiji Store EU operates this website and store, including the related information, content, features, tools, products and services made available through it, to provide customers with an online shopping experience. These are collectively referred to as the “Services”.

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.

These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies referred to in them, explain your rights and responsibilities when accessing or using the Services.

Please read these Terms carefully before using the Services or placing an order. They contain important information about your legal rights and obligations.

By accessing or using the Services or placing an order with us, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, you must not use the Services.

Nothing in these Terms affects any statutory rights you may have as a consumer that cannot lawfully be excluded or restricted.

SECTION 1 – ACCESS, ELIGIBILITY AND ACCOUNTS

You must be at least 18 years old, or the age of legal majority in the country where you live, to place an order through the Services.

You may permit a minor under your supervision to browse the Services using a device that you own or manage. However, orders must be placed by an adult who has legal capacity to enter into a binding contract.

When using the Services or placing an order, you may be asked to provide information including your name, email address, telephone number, billing address, delivery address and payment details.

You confirm that all information you provide is accurate, current and complete and that you are authorised to provide and use that information.

Where you create an account, you are responsible for:

  • maintaining the confidentiality of your login credentials;
  • restricting access to your account and devices; and
  • notifying us promptly if you believe that your account has been accessed without authorisation.

You must not transfer, sell or assign your account to another person.

We may suspend or close an account where we reasonably believe it has been used fraudulently, unlawfully or in material breach of these Terms.

SECTION 2 – PRODUCTS AND PRODUCT INFORMATION

We take reasonable care to ensure that product descriptions, photographs, prices, ingredients, quantities and other information displayed through the Services are accurate.

Product photographs are provided for illustrative purposes. Colours, packaging, labels and the appearance of products may differ slightly from the images displayed because of:

  • differences in device screens and display settings;
  • changes made by manufacturers;
  • regional packaging variations; or
  • reasonable changes to packaging that do not materially alter the product.

Packaging shown on the website may therefore differ from the packaging received.

For food and beverage products, you must read the product label, ingredient list, allergen information, preparation instructions and warnings supplied with the product before consuming or using it.

Although we aim to reproduce product information accurately, information displayed online must not be treated as a substitute for the information printed on the product packaging. Please contact us before ordering if you have a food allergy, intolerance or specific dietary requirement and require clarification.

We do not manufacture most of the products sold through the Services. Manufacturers may change ingredients, recipes, nutritional information, packaging or labelling without giving us advance notice. We will update the website when we become aware of a material change.

We reserve the right to:

  • correct product descriptions and other information;
  • change or discontinue products;
  • restrict the quantities available for purchase; and
  • restrict sales to particular countries or regions where reasonably necessary.

Any restriction will be applied lawfully and will not affect an order that we have already accepted unless there is a legitimate reason why we cannot fulfil it.

Nothing in this section excludes our responsibility to supply goods that conform to the contract, match their description and meet applicable consumer protection requirements.

SECTION 3 – ORDERS AND CONTRACT FORMATION

When you place an order, you are offering to purchase the selected products in accordance with these Terms.

After you submit an order, we may send an acknowledgement confirming that we have received it. An acknowledgement does not necessarily mean that your order has been accepted.

A legally binding contract is formed when we send you an order confirmation confirming that we have accepted your order or, if earlier, when we dispatch the products.

We reserve the right to decline or cancel an order before acceptance for legitimate reasons, including where:

  • a product is unavailable;
  • we cannot verify your payment or delivery information;
  • we identify a pricing or product-description error;
  • we reasonably suspect fraud or unauthorised activity;
  • the order exceeds an applicable quantity restriction;
  • we cannot lawfully deliver the product to your location; or
  • you have materially breached these Terms.

If we cannot accept an order after taking payment, we will refund the amount paid for the affected product and any related standard delivery charge.

Please check your order carefully before submitting it. Contact us promptly if you need to correct or cancel an order. We cannot guarantee that an order can be changed or cancelled after it has entered the fulfilment or dispatch process.

Your rights to cancel an online order after it has been accepted are explained in our Refund Policy and in Section 8 of these Terms.

Unless we expressly agree otherwise, purchases made through the consumer-facing Fiji Store EU store are intended for personal or household use and not for commercial resale.

Businesses wishing to purchase products for resale should contact us regarding a separate wholesale arrangement. Business-to-business purchases may be subject to separate commercial terms.

SECTION 4 – PRICES, TAXES AND PAYMENT

Prices displayed to consumers include applicable VAT or equivalent sales tax unless the website clearly states otherwise.

Delivery charges and any other mandatory charges will be displayed before you submit your order.

Where goods are delivered across an international border, the website or checkout will explain, where reasonably possible, whether import duties, taxes or customs charges are included in the amount paid.

Where charges are not included, you may be responsible for paying duties, taxes or customs clearance charges imposed by the destination country. We will not describe such charges as included unless they are included in the checkout price.

Prices, discounts and promotions may change without notice. These changes will not affect an order that we have already accepted, except where there is an obvious pricing error that you knew or reasonably should have recognised as an error.

The price payable will be shown during checkout and confirmed in your order confirmation.

Promotions may be subject to separate terms, including eligibility requirements, time limits and product exclusions. Where promotion-specific terms conflict with these Terms, the promotion-specific terms will apply to that promotion.

You must provide complete and accurate payment and billing information. You confirm that:

  • you are authorised to use the payment method provided;
  • the payment information is accurate and complete; and
  • sufficient funds or credit are available to complete the transaction.

Payment services may be provided by Shopify Payments or another third-party payment provider. We do not generally receive or retain your complete payment-card details.

SECTION 5 – AVAILABILITY AND SUBSTITUTIONS

All products are subject to availability.

Placing a product in your basket does not reserve it. Products may become unavailable before checkout or before we accept your order.

We will not substitute a materially different product without your agreement.

If a product becomes unavailable after your order has been accepted, we will contact you and offer, where appropriate:

  • a suitable alternative;
  • removal of the unavailable product from the order and a corresponding refund; or
  • cancellation and refund of the affected order.

SECTION 6 – SHIPPING AND DELIVERY

Available delivery methods, estimated delivery times and delivery charges will be displayed during checkout or explained in our Shipping Policy.

Delivery dates and times are estimates unless we expressly agree that a particular delivery date is essential.

We will take reasonable steps to deliver the products within the estimated timeframe. We are responsible for arranging delivery using reasonable care and are not automatically released from responsibility merely because a third-party carrier performs the delivery.

We are not responsible for a delay caused by an event outside our reasonable control. If a significant delay occurs, we will contact you as soon as reasonably possible and take steps to minimise its effect.

Unless another delivery period has been expressly agreed, we will deliver goods within the period required by applicable consumer law.

You are responsible for providing a complete and accurate delivery address. We are not responsible for failed delivery resulting directly from incorrect or incomplete information supplied by you, although we will reasonably assist you in resolving the issue.

Ownership of the products passes to you once we have received payment in full.

Risk of loss or damage remains with us until the products are delivered into your physical possession or into the possession of a person you have nominated to receive them.

Where you independently arrange a carrier that was not offered or arranged by us, risk may pass when the goods are handed to that carrier, to the extent permitted by applicable law.

Please inspect your delivery promptly and contact us as soon as reasonably possible if an item is missing, damaged or incorrect. A delay in contacting us does not remove any statutory rights you may have.

SECTION 7 – FOOD PRODUCTS, STORAGE AND DATE MARKINGS

You are responsible for following the storage, preparation and consumption instructions shown on the product packaging.

Some products may have a “best before” date rather than a “use by” date. A best-before date generally concerns product quality, while a use-by date concerns food safety.

We will not knowingly dispatch a product after its use-by date.

Because some imported products have long supply chains and limited production runs, products may be supplied with a shorter remaining best-before period than products commonly stocked by larger UK or EU retailers. Where a product has an unusually short remaining shelf life, we will aim to make this clear before purchase.

Nothing in this section affects your rights where a product is unsafe, defective, damaged, incorrectly described or otherwise fails to conform to the contract.

SECTION 8 – CANCELLATIONS, RETURNS AND REFUNDS

Returns, cancellations and refunds are governed by our Refund Policy, which forms part of these Terms.

8.1 Statutory cancellation rights

If you are a consumer purchasing online, you will normally have the right to cancel your order without giving a reason within 14 days after the day on which you, or a person nominated by you, receives the goods.

Where an order contains multiple products delivered separately, the cancellation period normally runs from the day after the final product is received.

To exercise the right to cancel, you must clearly notify us of your decision within the applicable cancellation period.

You will then normally have a further 14 days to return the goods, in accordance with our Refund Policy.

8.2 Exceptions to cancellation rights

The statutory right to cancel may not apply to certain products, including:

  • goods liable to deteriorate or expire rapidly;
  • goods made to your specifications or clearly personalised;
  • sealed goods that are not suitable for return for health-protection or hygiene reasons once unsealed;
  • goods that become inseparably mixed with other items after delivery; and
  • other products excluded from cancellation rights under applicable law.

An exception to the change-of-mind cancellation right does not remove your rights where goods are faulty, unsafe, damaged or incorrectly described.

8.3 Condition of returned goods

You may inspect goods in the same way that you reasonably could in a physical shop. You may be responsible for a reduction in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

8.4 Faulty or non-conforming goods

We are under a legal duty to supply goods that conform to the contract.

Nothing in these Terms or our Refund Policy limits your statutory rights where goods are:

  • faulty;
  • unsafe;
  • damaged before delivery;
  • not as described;
  • unfit for their intended purpose; or
  • otherwise not in conformity with the contract.

Depending on the circumstances and applicable law, you may be entitled to a refund, repair, replacement or price reduction.

For customers in the European Union, applicable national and EU consumer-law guarantees remain unaffected.

8.5 Refunds

Approved refunds will be made to the original payment method unless otherwise agreed or permitted by law.

Refund timing and any deductions permitted by law are explained in our Refund Policy.

SECTION 9 – INTELLECTUAL PROPERTY

The Services and their contents—including text, graphics, logos, branding, photographs, videos, audio, website design and arrangement—are owned by or licensed to Fiji Store Ltd, Shopify or the relevant third-party rights holder.

These materials are protected by applicable copyright, trademark and other intellectual-property laws.

You may access and use the Services for your personal, lawful and non-commercial use.

Unless permitted by law or authorised by us in writing, you must not:

  • reproduce, republish or distribute substantial parts of the Services;
  • modify or create derivative works from our materials;
  • use our content for commercial purposes;
  • remove copyright, trademark or ownership notices;
  • use our trademarks or branding in a way that suggests an unauthorised association or endorsement; or
  • systematically extract or reuse website content or data.

“Fiji Store EU”, “Fiji Store”, associated logos, trading names, designs and slogans are trademarks or commercial identifiers belonging to or licensed to Fiji Store Ltd.

Shopify’s names, logos, products and services are trademarks belonging to Shopify or its affiliates.

All other trademarks appearing through the Services belong to their respective owners.

Nothing in these Terms grants you ownership of, or a licence to use, any intellectual property except for the limited right to access and use the Services in accordance with these Terms.

SECTION 10 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools, applications, payment services, social-media features or other functionality operated by third parties.

Third-party services may be subject to their own terms and privacy policies. You should review those terms before using the relevant service.

We do not control third-party services and cannot guarantee that they will always be available, uninterrupted or error-free.

Nothing in this section excludes responsibility that we are legally required to accept for a third party that we use to fulfil our contract with you.

We may introduce new features, tools or resources. Unless separate terms are provided, those features will form part of the Services and be governed by these Terms.

SECTION 11 – THIRD-PARTY LINKS

The Services may contain links to websites or platforms operated by third parties.

We do not control third-party websites and are not responsible for their content, availability, security, terms, products or privacy practices.

A link does not necessarily mean that we endorse the third party or its products or services.

When you leave our Services, you should review the terms and privacy policies of the third-party website before providing information or completing a transaction.

Complaints or questions concerning products or services purchased directly from a third party should be addressed to that third party.

This section does not affect any responsibility we may have where the third party is acting on our behalf in fulfilling your contract with us.

SECTION 12 – RELATIONSHIP WITH SHOPIFY

Fiji Store EU is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.

Any sale made through the Fiji Store EU store is made directly between you and Fiji Store Ltd, not Shopify.

Shopify is not the seller of our products and is not responsible for fulfilling your order, providing customer service for our products or dealing with product-related returns and refunds.

Nothing in this section limits any rights you may have directly against Shopify under applicable law or under a separate agreement between you and Shopify.

SECTION 13 – PRIVACY AND COOKIES

Our collection and use of personal information are governed by our Privacy Policy, available at [INSERT PRIVACY POLICY LINK].

We use cookies and similar technologies in accordance with our Cookie Policy and the choices available through our cookie-consent tool.

Because the Services are hosted by Shopify, Shopify collects and processes certain personal information relating to your access to and use of the Services. Shopify’s handling of personal information is explained in Shopify’s own consumer privacy policy.

Information may be processed by Shopify and other service providers in countries outside the country where you live, subject to the safeguards explained in our Privacy Policy.

By using the Services, you acknowledge that you have been given access to our Privacy Policy. Where consent is required for particular cookies, marketing or other processing activities, we will request that consent separately.

SECTION 14 – REVIEWS, COMMENTS AND FEEDBACK

You may be able to submit reviews, comments, suggestions, photographs or other content through the Services. In these Terms, this content is referred to as “Feedback”.

You retain ownership of your Feedback.

By submitting Feedback, you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, adapt and use it for the purposes of:

  • operating and improving the Services;
  • displaying customer reviews;
  • responding to your submission; and
  • promoting our products and business.

This licence lasts for as long as reasonably necessary for those purposes, subject to your data-protection and other legal rights.

You confirm that:

  • you own the Feedback or have permission to submit it;
  • the Feedback is honest and relates to your genuine experience where presented as a review;
  • you have disclosed any payment, free product or other incentive connected with the Feedback; and
  • the Feedback does not infringe another person’s rights.

Feedback must not contain unlawful, threatening, abusive, defamatory, discriminatory, obscene, deceptive or malicious material, personal information belonging to another person, or software designed to damage or disrupt the Services.

We may moderate, reject or remove Feedback where we reasonably believe it breaches these Terms, applicable law or our review policies.

We will not knowingly manipulate customer reviews or present incentivised reviews as independent reviews.

SECTION 15 – ERRORS, INACCURACIES AND OMISSIONS

We may occasionally make typographical, administrative or technical errors relating to product descriptions, prices, discounts, delivery charges, transit times or availability.

We may correct errors and update information at any time.

Where an error affects an order you have already placed, we will contact you as soon as reasonably possible. Where appropriate, we will give you the choice of:

  • confirming the order using the corrected information; or
  • cancelling the affected product or order for a full refund.

We will not rely on this section to make a material change to an accepted contract without a legitimate reason or where doing so would breach applicable consumer law.

SECTION 16 – PROHIBITED USES

You may use the Services only for lawful purposes.

You must not use or attempt to use the Services:

  • to commit or facilitate unlawful, fraudulent or malicious activity;
  • to infringe our rights or the rights of another person;
  • to harass, threaten, abuse, defame or unlawfully discriminate against another person;
  • to submit false or materially misleading information;
  • to impersonate another person or organisation;
  • to transmit viruses, malware or other harmful code;
  • to send unauthorised spam or promotional communications;
  • to collect personal information about other people without lawful authority;
  • to interfere with the operation or security of the Services;
  • to bypass access controls or technical restrictions;
  • to scrape, extract or systematically collect website content or data without our permission, except where such restriction is prohibited by law;
  • to make fraudulent purchases or payment claims; or
  • in any way that could damage the Services or prevent other people from using them.

We may take reasonable steps to prevent automated systems, bots or artificial-intelligence agents from accessing or interacting with the Services where such access threatens security, disrupts operations, breaches these Terms or places an unreasonable burden on our systems.

Nothing in this section prevents lawful activity that cannot legally be restricted, including lawful use of publicly available information where applicable.

We may suspend or terminate access where we reasonably believe that a material breach has occurred.

SECTION 17 – SUSPENSION AND TERMINATION

You may stop using the Services at any time.

We may suspend or terminate your account or access to some or all of the Services if:

  • you materially or repeatedly breach these Terms;
  • we reasonably suspect fraud or unlawful activity;
  • your use creates a security or operational risk;
  • we are required to do so by law; or
  • we discontinue the relevant Service.

Where reasonably possible, we will give you notice and an opportunity to address the issue before termination, unless immediate action is justified.

Termination does not affect:

  • rights or obligations that arose before termination;
  • an accepted order, unless that order is lawfully cancelled;
  • any amounts properly due; or
  • provisions that are intended to continue after termination.

SECTION 18 – AVAILABILITY OF THE SERVICES

We aim to keep the Services available and functioning correctly, but we do not guarantee uninterrupted access.

We may temporarily suspend or restrict the Services for maintenance, security, technical or operational reasons.

We will take reasonable steps to minimise disruption where practical.

The general information made available through the Services is provided for information only and should not be relied upon as professional medical, legal, financial, nutritional or other specialist advice.

This section does not affect our obligation to provide products that comply with your contract and applicable consumer law.

SECTION 19 – OUR RESPONSIBILITY TO YOU

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of statutory consumer rights;
  • defective products where liability cannot lawfully be excluded;
  • wilful misconduct or gross negligence where applicable; or
  • any other liability that cannot legally be excluded or limited.

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

A loss is foreseeable where it was obvious that it would happen or where, when the contract was formed, both parties knew that it might happen.

We supply consumer products only for private use unless we have expressly agreed to a business-to-business sale. Where you purchase as a consumer, we are not responsible for business losses, including loss of profit, revenue, contracts, opportunity or business interruption.

We are not responsible for losses caused solely by:

  • your failure to follow clear product instructions or warnings;
  • inaccurate information provided by you;
  • your unlawful use of the Services or products; or
  • an event outside our reasonable control, except where applicable law places responsibility on us.

Nothing in these Terms affects remedies available under applicable consumer law.

SECTION 20 – EVENTS OUTSIDE OUR REASONABLE CONTROL

We are not responsible for a failure or delay caused by circumstances outside our reasonable control.

Such circumstances may include severe weather, flooding, fire, epidemic, pandemic, war, civil disturbance, industrial action involving third parties, transport disruption, port closure, customs disruption, government action, interruption of utilities or telecommunications, and failure of third-party networks.

If such an event affects our performance, we will:

  • contact you as soon as reasonably possible;
  • take reasonable steps to minimise the impact; and
  • resume performance when reasonably possible.

Where the event causes a substantial delay or prevents us from fulfilling the contract, you may have the right to cancel and receive a refund for products not supplied.

SECTION 21 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or modified to the minimum extent necessary.

The remaining provisions will continue in effect.

SECTION 22 – WAIVER

If we do not immediately enforce a right or remedy under these Terms, this does not mean that we have waived that right or remedy.

A waiver will be effective only where it is clearly given and will apply only to the particular circumstances for which it was given.

SECTION 23 – ENTIRE AGREEMENT

These Terms and the policies expressly incorporated into them form the agreement between you and us regarding your use of the Services and any order placed through them.

They replace previous versions of these Terms relating to the same subject matter.

Nothing in this section excludes liability for fraud or prevents you from relying on statements that form part of the contract under applicable consumer law.

SECTION 24 – TRANSFER OF RIGHTS

You may not transfer your rights or obligations under these Terms to another person without our written agreement, except where applicable law gives you the right to do so.

We may transfer our rights or obligations to another organisation—for example, as part of a business sale or restructuring—provided that the transfer does not reduce your contractual or statutory rights.

We will notify you where required by law.

SECTION 25 – THIRD-PARTY RIGHTS

Except for Shopify where expressly stated and any lawful successor or assignee of Fiji Store Ltd, no person who is not a party to these Terms has a right to enforce them.

This does not affect any right or remedy available to a third party under applicable law.

SECTION 26 – GOVERNING LAW AND DISPUTES

These Terms and contracts formed through the Services are governed by the laws of England and Wales.

If you live in England or Wales, the courts of England and Wales will have jurisdiction over disputes.

If you live in Scotland, Northern Ireland or another part of the United Kingdom, you may bring proceedings in the courts of the part of the United Kingdom where you live.

If you are a consumer living in a European Union or European Economic Area country, you may also be entitled to bring proceedings in the courts of the country where you live and to rely on mandatory consumer protections under the laws of that country.

Nothing in this section removes any mandatory protection or right to use a local court that applicable consumer law gives you.

Before starting legal proceedings, we encourage you to contact us so that we can try to resolve the matter directly.

SECTION 27 – COMPLAINTS

Please contact us using the details in Section 30 if you have a complaint.

We will aim to acknowledge and investigate complaints within a reasonable period.

These Terms do not prevent you from contacting a consumer-protection authority, trading standards body, supervisory authority, court or approved alternative dispute-resolution provider where you are entitled to do so.

SECTION 28 – HEADINGS

Section headings are included for convenience only and do not affect the interpretation of these Terms.

SECTION 29 – CHANGES TO THESE TERMS

You can review the current version of these Terms on this page.

We may amend these Terms to reflect:

  • changes to the Services;
  • changes to our business operations;
  • security or technical requirements; or
  • changes in legal or regulatory requirements.

The revised Terms will be posted on the website with an updated “Last updated” date.

Where required by law, we will provide additional notice of material changes.

Changes will not normally apply retrospectively to an order already accepted unless the change is required by law or you agree to it.

Your continued use of the Services after revised Terms take effect will constitute acceptance of the revised Terms in relation to future use. This does not remove any rights relating to an order placed under an earlier version.
